Washtakiwa wapiga makofi wakihukumiwa faini ya Sh40,000

Dar es Salaam. Mahakama ya Hakimu Mkazi Kisutu, imewahukumu Watanzania 64 kulipa faini ya Sh40,000 kila mmoja au kwenda jela miezi sita, baada ya kupatikana na hatia ya kuondoka ndani ya Jamhuri ya Muungano wa Tanzania na kwenda Afrika Kusini bila kufuata taratibu za uhamiaji.

Waliohukumiwa adhabu hiyo katika kesi ya jinai namba 31302 /2024  ni Abdallah Ramadhani, Abdul Rajab, Abdulrahman Mtimbe, Abdul Lusambi, Abubakary Kitemba, Ally Maduka, Adam Mkumba, Akida Ally, Ally Ally na wenzao 54.

Washtakiwa hao baada ya kuhukumiwa, walishangilia kwa kupiga makofi wakiwa ndani ya mahakama ya wazi namba moja, wakifurahia kupigwa faini ya Sh40,000.

Hata hivyo, washtakiwa hao wamefanikiwa kulipa faini na kukwepa adhabu ya kwenda kutumikia kifungo cha miezi sita jela.

Hukumu hiyo imetolewa leo Jumatano, Novemba 6, 2024 na Hakimu Mkazi Mkuu wa mahakama hiyo, Beda Nyaki baada ya washtakiwa kukiri kosa lao na Mahakama kuwatiwa hatiani kwa kosa hilo.

Hakimu Nyaki amesema washtakiwa wametiwa hatiani kama walivyoshtakiwa kwa kuwa wamekiri wenyewe shtaka lao, hivyo anawahukumu kila mshtakiwa kulipa faini Sh 40,000 na wakishindwa watatumikia kifungo cha miezi sita jela kila mmoja.

Awali, Wakili wa Serikali kutoka Idara ya  Uhamiaji, Ezekiel Kibona na Grace Nyarata waliwasomea shtaka hilo washtakiwa hao ambapo walidaiwa kutenda kosa hilo Oktoba 29, 2024 katika uwanja wa ndege wa Kimataifa wa Julius Nyerere ( JNIA), uliopo Wilaya ya Ilala, jijini Dar es Salaam.

Ilidaiwa siku hiyo, washtakiwa wakiwa raia wa Tanzania, waliondoka isivyo halali katika ardhi ya Tanzania bila kibali na kueleleka nchini Afrika Kusini.

Washtakiwa baada ya kusomewa shtaka lao walikiri kutenda kosa hilo na ndipo upande wa mashtaka walipowasomewa hoja za awali.

Akiwasomea maelezo ya awali (PH), wakili Kibona alidai washtakiwa waliondoka nchini bila kufuata taratibu wa uhamiaji wa kutoka na kuingia nchini.

Alidai kwa nyakati tofauti waliondoka Tanzania bila kufuata utaratibu, bila kuwa na hati ya kusafiria au nyaraka yoyote na pia walishindwa kupita kwenye mipaka rasmi iliyoainishwa na sheria za uhamiaji ikishirikiana na Serikali, ili kujua madhumuni ya safari zao.

Iliendelea kudaiwa kwa nyakati tofauti washtakiwa hao walielekea nchini Afrika Kusini na kufanikiwa kuingia katika nchi hiyo na kuishi kinyemela.

Ilidaiwa wakiwa nchini humo walisambaa maeneo tofauti tofauti wakati wakijua ni kinyume cha sheria.

“Baada ya kukamatwa, walirejeshwa nchini Tanzania kupitia uwanja wa Ndege wa Kimataifa wa Julius Nyerere (JNIA) uliopo Wilaya ya Ilala na kisha walipelekwa Ofisi ya Uhamiaji Mkoa wa Dar es Salaam kwa ajili ya mahojiano na uchunguzi,” alidai Kibona.

Alidai baada ya kuhojiwa Idara ya Uhamiaji, washtakiwa walikiri kuondoka nchini, huku wakiwa hawana hati za kusafiria na hivyo kufikishwa mahakamani.

Wakili Kibona aliomba Mahakama itoe adhabu kwa mujibu wa sheria waliyoshtakiwa nayo, ili iwe fundisho kwa vijana wengine.

“Tunaiomba Mahakama itoe adhabu kwa mujibu wa sheria, ili iwe fundisho kwa vijana  wengine wenye nia ovu wanaokwenda Afrika Kusini bila kufuata utaratibu, jambo ambalo ni kinyume cha sheria,” alieleza Kibona.

Kabla ya kutoa hukumu, Mahakama iliwapa nafasi washtakiwa kujitetea kwanini wasipewe adhabu kali baada ya kukiri shtaka hilo, nao waliomba kupunguziwa adhabu kwa kuwa wamejutia kosa lao, hivyo wamejifunza na hawatarudia tena.

Akitoa uamuzi, Hakimu Nyaki amesema Mahakama imezingatia washtakiwa ni wakosaji wa mara ya kwanza na wamejutia kosa lao, na amezingatia maelezo yaliyotolewa na upande wa mashtaka kuwa washtakiwa hao hawana rekodi za makosa ya nyuma na jinsi walivyokiri kwa dhati shtaka lao.

“Kutokana na mazingira hayo, Mahakama inawahukumu kulipa faini ya Sh 40,000 kila mmoja na mtuhumiwa akishindwa kulipa faini hiyo atatumikia kifungo cha miezi sita jela kila mmoja,” amesema Hakimu Nyaki.

Baada ya kutoa hukumu hiyo, washtakiwa walipiga makofi na kushangilia kuhusiana na faini hiyo ilitolewa na mahakama hiyo.

Tanzania Declares Marburg Outbreak – Africa CDC Mobilizes Immediate Response

Addis Ababa, January 20, 2025</Strong> — Tanzania has declared a Marburg virus disease (MVD) outbreak after confirming one case and identifying 25 suspected cases in the Kagera Region of Northwestern Tanzania. The Marburg virus, a highly infectious and often fatal disease, is similar to Ebola and is transmitted to humans from fruit bats and monkeys. This outbreak marks the nation’s second encounter with the deadly virus, following the outbreak in Bukoba District of Kagera Region in March 2023, which resulted in nine cases and six deaths.

In response to this urgent threat, the Africa CDC is mobilizing strong support to help Tanzania contain the outbreak. A team of twelve public health experts will be deployed as part of an advance mission in the next 24 hours. The multidisciplinary team includes epidemiologists, risk communication, infection prevention and control (IPC), and laboratory experts to provide on-ground support for surveillance, IPC, diagnostics, and community engagement.

The Director-General of Africa CDC, Dr. Jean Kaseya, has engaged with Tanzania’s President Samia Suluhu Hassan and the Minister of Health to ensure coordinated efforts and secure political commitment for the response.

“Africa CDC stands firmly with Tanzania in this critical moment. To support the government’s efforts, we are committing US$ 2 million to bolster immediate response measures, including deploying public health experts, strengthening diagnostics, and enhancing case management. Building on Tanzania’s commendable response during the 2023 outbreak, we are confident that swift and decisive action, combined with our support and those of other partners, will bring this outbreak under control,” Dr. Kaseya stated.

Africa CDC has recently supported efforts to enhance the diagnostic and sequencing capacity of public health laboratories in Tanzania. PCR Test kits and genomic sequencing reagents have been dispatched, with additional supplies in the pipeline. To ensure rapid identification and confirmation of cases, the institution will also provide technical assistance to strengthen detection and genome sequencing for better characterization of the pathogen. Additionally, support will be provided to improve case management protocols and enhance the capacity to deliver safe and effective treatment.

Africa CDC is committed to working closely with the Government of Tanzania, regional partners, international organizations, and global stakeholders, including the World Health Organization, to stop the spread of the Marburg virus.
