Jaji Kilimi: Kifungo hiki cha miezi sita kwa mdhamini kilikuwa batili

Moshi. Mahakama Kuu ya Tanzania, imeingilia kati na kubatilisha adhabu ya kifungo cha miezi sita jela, alichohukumiwa Hashim Msoma baada ya mshtakiwa aliyemdhamini kuruka dhamana, na kuagiza aachiwe huru na kutoka gerezani.

Katika uamuzi alioutoa Juni 14, 2024, Jaji Adrian Kilimi wa Mahakama Kuu kanda ya Moshi, aliwakumbusha mahakimu kusoma miongozo inayotolewa na mhimili wa mahakama kwa lengo la kuboresha taaluma yao ikiwamo taratibu za dhamana.

Jaji alisema katika utafiti wake, amebaini kuna miongozo mitano kwa ajili ya maofisa wa mahakama inayopatikana kwa njia ya kielektroniki katika tovuti ya Tanzilii ukiwemo mahususi kwa ajili ya taratibu za dhamana wa mwaka 2020.

“Hukumu ya kifungo cha miezi sita kwa mdhamini ilikuwa wazi kuwa haikuhitajika na haiwezi kuruhusiwa kusimama,” alisisitiza Jaji Kilimi.

Jaji Kilimi kwa kutumia mamlaka aliyopewa na kifungu namba 373(1) cha sheria ya mwenendo wa mashauri ya Jinai (CPA) kama ilivyofanyiwa marejeo mwaka 2022, ameibatilisha adhabu hiyo kwa kuwa ilikuwa haramu mbele ya sheria.

Jaji Kilimi alitoa uamuzi huo kutokana na marejeo ya kesi hiyo yaliyoanzishwa na mahakama yenyewe  baada ya kupokea barua ya malalamiko Juni 7, 2024 kwenda kwa Jaji Mfawidhi kuhusiana na mdhamini huyo kutupwa jela.

Ndugu wa mdhamini huyo walilipa dhamana (bond) ya Sh2 milioni siku hiyohiyo mdhamini huyo alipoamriwa kuilipa kupitia ‘control number’ 991401130291, wakati huo akiwa mahabusu ya mahakama, lakini polisi walimpeleka gerezani.

Kiini cha Mahakama kuingilia kati

Katika kesi ya jinai namba 28 ya mwaka 2024 katika Wilaya ya Moshi, watuhumiwa wawili, David Shoo na Elia Godfrey walifikishwa kortini wakishtakiwa kwa wizi ambapo mshtakiwa wa kwanza (Shoo) alikiri kosa na kuhukumiwa.

Hata hivyo mshtakiwa wa pili, Elia Godfrey alikanusha shitaka na mahakama ikaweka masharti ya dhamana ambapo Hashim Msoma aliidhinishwa na mahakama kuwa mdhamini na akasaini dhamana ya Sh2 milioni.

Lakini baadaye mshitakiwa aliyemdhamini aliruka dhamana ambapo kumbukumbu za mahakama zikaonyesha kuwa Juni 5,2024, mdhamini alifika mahakamani na kuieleza mahakama kuwa alipomdhamini Godfrey alijua asingemwangusha.

Mahakama baada ya kusikiliza hoja yake hiyo na kwa kuwa hakuwa na mali ambayo ingeweza kutaifishwa na kufidia kiwango cha dhamana alichokuwa amesaini, akamwamuru kwenda jela miezi sita.

Kutokana na kumbukumbu hiyo, mahakama Kuu ikaona ni sahihi kuita pande zote mbili kwa maana ya mwathirika na Jamhuri ili kuieleza mahakama nini kilitokea mahakamani, ambapo Hashim alifika kortini mwenyewe kujiwakilisha.

Hoja zilizowasilishwa kortini

Katika maelezo yake, mdhamini alisema alipewa wiki mbili kumtafuta mshtakiwa aliyemdhamini lakini alishindwa kufahamu mahali alipo na alipofika mahakamani alikamatwa na hakimu akamtaka kulipa bond ya Sh2 milioni au kwenda jela miezi sita.

Alimweleza Jaji kuwa alimuomba hakimu apewe muda wa kutafuta fedha hizo, na mama yake aliyekuwepo mahakamani, alikimbia nje na kutafuta fedha hizo na kuzilipa mahakama wakati huo mdhamini akiwa mahabusu ndogo ya mahakama.

Lakini baadaye Polisi walimpeleka mdhamini huyo mahabusu katika Gereza Kuu la Karanga ambako alisema ameshakaa wiki moja na siku moja hivyo akaiomba mahakama iangalie uwezekano wa kumpa dhamana au imuachie kwa masharti.

Akijibu hoja hizo, wakili wa Serikali kutoka Ofisi ya Taifa ya Mashitaka (NPS), Issa Mangumu, hakupinga maombi hayo, na akaeleza kuwa Juni 5,2024 mdhamini huyo aliitwa kortini kueleza kwa nini asilipe bondi au kwenda jela miezi sita.

Baada ya kusikiliza hoja zake siku hiyo, hakimu anayesikiliza shauri hilo alimuamuru mdhamini huyo kwenda jela miezi sita, lakini wakati huohuo, dhamana hiyo ya Sh2 milioni ilikuwa tayari imelipwa na ndugu zake.

Wakili huyo alieleza kuwa vifungu vinavyosimamia namna gani mdhamini atendewe baada ya aliyemdhamini kuruka dhamana, vinapatikana katika kifungu cha 160(1) cha CPA sura ya 20 RE 2022 ambacho kinaeleza taratibu za kufuatwa.

Utaratibu, kwa mujibu wa wakili huyo, ni pamoja na mdhamini kupewa muda wa kulipa, na kama atashindwa hatua inayofuata ni kukamatiwa mali zake ili ziuzwe kwa mnada kulipa bondi na kama hana ndipo ataenda jela miezi sita.

Wakili huyo aliongeza kusema kuwa ni wazi taratibu hizo hazikufuatwa kwa hiyo kifungo hicho alichopewa ni kinyume cha sheria na akaongeza kueleza kuwa mdhamini huyo tayari alikuwa ameshalipa Sh2 milini alizosaini kama bondi.

Uamuzi wa Jaji Kilimi

Baada ya kusikiliza hoja hizo, alisema kifungu hicho namba 160 cha CPA kimeweka taratibu za kutaifisha mali pale ambapo mshtakiwa anaruka dhamana, lakini kulingana na Mwongozo wa Mahakama wa 2020, imeweka pia utaratibu.

Sheria hiyo inasema pale mshtakiwa atakaporuka dhamana na mdhamini kushindwa kumleta, mahakama itamtaka mdhamini kufika mbele yake kueleza kwa nini bondi yake isitaifishwe, akishindwa mahakama ndio itapanga kiwango hicho.

Lakini pia inasema pale ambapo mahakama inaagiza kutaifishwa, itampa mdhamini muda wa kutosha wa kulipa kiwango kilichopangwa na mahakama na akishindwa, mahakama itatoa hati ya kukamatwa kwa mali zake zinazohamishika.

Kama atakuwa amekufa, sheria hiyo imeeleza kama kiwango cha fedha hakitalipwa na hakiwezekani kupatikana kwa kukamata mali, basi mdhamini atawajibika kutumikia kifungo cha miezi sita gerezani.

Jaji akasema kulingana na kumbukumbu za mahakama ni kwamba ingawa mdhamini alikubali kupewa muda wa kumtafuta mshitakiwa, kumbukumbu hizo hazionyeshi kwa kikamilifu ni lini mdhamini alipewa haki hiyo.

Lakini pia Jaji alisema kumbukumbu hizo zinaonyesha kuwa mdhamini aliiambia mahakama kwamba hana mali za kutaifishwa badala ya bondi, lakini zinaonyesha pia kuwa mahakama ilimuhukumu kwa kifungu 160 (4) kwenda jela miezi sita.

Jaji alisema kama alivyowasilisha hoja zake wakili Mangumu, taratibu hazikufuatwa kwa hiyo ilikuwa ni batili na hata kama mdhamini alisema hana mali, mahakama ingempa muda wa kulipa kiwango ambacho imekipanga.

Kulingana na Jaji, endapo angeshindwa ndipo mahakama ingetoa hati ya kukamata mali zinazohamishika kama zipo, hivyo kwa maoni yake kile ambacho kilifanywa na mahakama ni kurukia hatua ya mwisho bila kumaliza hatua za awali.

“Kwa hiyo naweza kusema ingawa mdhamini alisema hana mali , kabla ya mahakama haijahitimisha, alikuwa na nafasi nyingine ya kupewa muda wa kulipa fedha,”alisema Jaji Kilimi katika uamuzi wake huo na kuongeza kuwa,

“Kiukweli, kumbukumbu zinaonyesha baada ya mshtakiwa kuruka dhamana, mdhamini alifika kortini Juni 5,2024 na taratibu zote hizo za kisheria zikakamilika siku hiyohiyo. Hapa nakubali taratibu zilikiukwa hivyo kuwa batili”

Jaji alisema kwa vyovyote vile iwavyo, siku hiyohiyo ambayo mdhamini alihukumiwa adhabu ya kifungo cha miezi sita gerezani, ndugu zake tayari walikuwa wamelipa hicho kiasi cha fedha lakini licha ya kulipa, bado alipelekwa gerezani.

Kutokana na uchambuzi huo wa Jaji, alisema ni wazi amri ya kifungo cha miezi sita kwa mdhamini ilikuwa wazi kuwa haikuhitajika na haiwezi kuruhusiwa kusimama, hivyo akabatilisha adhabu hiyo na kuagiza aachiliwe mara moja kutoka gerezani.

Tanzania: Exim to Raise Fund for Mental Health Facilities Upgrades

EXIM Bank to raise 300m/- over the next three years for financing essential services and infrastructure upgrades in mental health facilities.

The bank’s Head of Marketing and Communications Stanley Kafu unveiled this when introducing Exim Bima Festival 2024 as a platform for bringing together individuals, organisations and various sectors for raising the funds.

“Exim’s initiative aligns with the government’s broader goals to ensure that every citizen has access to quality healthcare, including mental health services,” he said.

The initiative, which is one of the events for celebrating the bank’s 27th anniversary is scheduled for Wednesday this week in Dar es Salaam.

Mr Kafu highlights that this year’s festival is not only about raising awareness of the importance of insurance in the society but also focuses on enhancing access to mental health services and improving the overall well-being of the nation.

Statistics from the Ministry of Health shows a staggering 82 per cent increase in mental health cases over the past decade.

Mental cases have risen from 386,358 in 2012 to 2,102,726 in 2021, making the need for mental health services more urgent than ever.

Unfortunately, the country’s ability to address this growing challenge is hindered by a shortage of mental health professionals, infrastructure, medical equipment and essential medication.

For example, out of the 28 regions in the country, only five have facilities that provide adequate mental health services.

The most affected group is the youth aged 15 to 39, who represent the nation’s workforce, underscoring the need for intensified efforts to safeguard this generation for Tanzania’s future well-being and development.

Mr Kafu said by improving mental health services, Exim aims to contribute to the creation of a network of communities that can access care quickly and affordably.

Exim Insurance Department Manager Tike Mwakyoma said they are appreciating the support from partners in the insurance industry, who have stood by them since the last festival.

“Let’s continue this unity for the development of all Tanzanians and our nation as a whole,” the manager said.
